Lithium and live equipment shipping underreporting serious consequences, why repeated prohibition?

In the current global market, the demand for lithium batteries and equipment with lithium batteries is increasing, especially driven by new energy vehicles, energy storage systems and other fields, the export volume of China-made live equipment ranks first in the world. However, due to the special properties of its lithium batteries and live equipment, its export transportation is an extremely complex and dangerous challenge, not only the shipping company for carrying live equipment to ship to certain requirements, there are also relevant international regulations. In this paper, Sungreen Logistics, a dangerous goods forwarder, comprehensively interprets the consequences of the underreporting of lithium batteries and live equipment.

Transportation requirements for lithium batteries and live equipment

As a high energy density power supply equipment, lithium batteries play a crucial role in modern electronic equipment and new energy fields. However, due to their special chemical properties, lithium batteries have certain safety risks during transportation. Therefore, international logistics has strict regulations and requirements for the transportation of lithium batteries.

When exporting lithium batteries and their equipment with lithium batteries, it is first necessary to clarify their dangerous goods category and UN number. According to the International Dangerous Goods Transport Code, lithium batteries and their equipment are generally classified as Category 9 dangerous goods and need to strictly comply with the relevant transport regulations and standards. In addition, it is also necessary to prepare complete documents, such as dangerous bag certificate, MSDS, UN38.3 identification report, etc., to ensure compliance and safety of the transportation process.

Different batteries in international logistics transport rules

In international logistics, batteries are special dangerous goods and need to be handled with special care. Lithium batteries are the most common, and they are classified as dangerous Goods transport Category 9, corresponding to the UN number UN3480. If batteries have been used on mobile phones or other devices, such batteries are also Class 9 dangerous goods, number UN3481.

In addition to lithium batteries, there are other types of batteries that also have specific transport rules. For example, lithium metal batteries and lithium metal battery packs are also class 9 dangerous goods, numbered UN3090 and UN3091 respectively. Batteries, depending on the type of electrolyte they use (such as acidic and alkaline), are also classified as dangerous goods, usually class 8. These batteries, if they contain solid potassium hydroxide and are dry, are also classified as Category 8 dangerous goods, number UN3028.

Lithium battery export transportation

Different types of batteries have different transport rules and modes of operation. During the transportation process, we must strictly comply with the relevant regulations to ensure safety compliance. Lithium batteries, vehicles powered by lithium batteries and equipment powered by lithium batteries are classified as Category 9 dangerous goods under the UN codes UN3480, UN3171 and UN3481.

Lithium battery conceals the consequences of shipment

Once an accident occurs in the transportation of lithium batteries, it not only involves economic losses, but also may pose a threat to human life and social security. Therefore, the consequences of the underreporting of lithium battery exports are serious:

1. Maritime inspection and fines

Once the maritime authorities find that dangerous goods are hidden, the goods will be detained and fined according to the degree of violation. In addition, shippers are required to submit information statements and may face the risk of retroactive records for the past three years.

2. Criminal liability

Serious underreporting may constitute a criminal offence. There are many cases in which the owner, forwarder and customs broker are sentenced for concealment.

3. Shipping company fines

If the shipping company is found to be concealing lithium battery products, especially UN3171 and UN3480, the cargo owner and booking agent will face a fine of up to USD15,000, so the shipping company is very strict about the export inspection of lithium battery products.

4. Insurance lapses

As it is illegal to underreport, any agreements and insurance related to the goods will be void. Not only will the insurance company not settle the claim, it may also pursue the responsible party for legal liability.

5. Risk of destination port

Even if the goods are not found in the port of origin and during sea transportation, they may face inspection by customs, maritime, port and other departments after arriving at the port of destination, and there is a risk of being detained and paying huge fines. Especially in Europe and the United States, the inspection of lithium battery products is very strict.

6. Return and repair problems

If the goods arrive in the hands of the consignee by chance, but need to be returned or repaired due to product quality problems, the import of goods will face the risk of strict inspection and high fines due to the concealment of the port of origin.
