The United States has added a number of Chinese entities to its "entity list" of export controls, the Ministry of Commerce has responded
On August 25, according to the Ministry of Commerce, the spokesperson of the Ministry of Commerce answered a reporter's question on the US placing a number of Chinese entities on the "entity list" of export control on the grounds of involvement in Russia.

Recently, the US Department of Commerce announced that a number of Chinese entities will be included in the "entity list" of export control on the grounds of involvement in Russia. The spokesperson of the Ministry of Commerce said that China has taken note of relevant situation. The US has added a number of Chinese entities to its "entity list" of export control under the so-called pretext of being involved in Russia. China is firmly opposed to this.


Response of the Ministry of Commerce


A spokesperson for the Ministry of Commerce said that the US actions are typical unilateral sanctions and "long-arm jurisdiction", which undermine the international trade order and rules, hinder normal international economic and trade exchanges, and affect the security and stability of the global industrial chain and supply chain. China is strongly dissatisfied with and firmly opposed to this. China urges the US side to immediately stop its wrong practices and will take necessary measures to resolutely safeguard the legitimate rights and interests of Chinese companies.

On August 23, local time, the United States expanded export controls related to Russia. The U.S. Department of Commerce's Bureau of Industry and Security (BIS) announced an update to its export control rules and added 123 entities under 131 lists to the Entity List for strict export controls, including 42 Chinese entities and addresses.

The reporter learned that these entities included in this round of list are mainly electronic component distributors in the field of chip semiconductor industry chain. In addition, there are more than 70 overseas address companies on the list, covering Ukraine, Iran, Kazakhstan, Kyrgyzstan, Russia, Turkey, Ukraine and the United Arab Emirates.

The BIS said in the document that the above 123 entities were added because these entities are related to, have supplied or cooperated with Russia's unmanned aerial vehicle (UAV) program, or Russian military industry, as part of a new round of sanctions against Russia, and these entities have been determined by the US government to be acting contrary to US national security or foreign policy interests.

According to BIS regulations, after the above 42 Chinese entities are included in the Entity List, U.S. enterprises need to apply for permission from the U.S. government when exporting, re-exporting, and transferring all products and technologies covered by the Export Administration Regulations (EAR) to these entities. At the same time, the US Department of Commerce has adopted the principle of "presumed refusal" for Chinese entities, that is, refusal to approve licenses in principle. In addition, BIS has "long-arm jurisdiction" to enforce the Foreign Direct Product Rule (FDP) on these entities, meaning that products produced directly using software and technology controlled by the US Export Administration Regulations need to obtain a US license even if they are not produced in the US.
